California Shine the Light Law

As defined in California’s “Shine the Light Law,” California residents may annually request and obtain information that is shared with other businesses for their own direct marketing use within the prior calendar year. Mauldin & Jenkins does not share your personal information with other businesses for those other businesses’ own direct marketing use.

To make a request under the Shine the Light Law, please contact Mauldin & Jenkins as described in the “How to Submit a Request” section below. In your request, please state that you are a California resident and provide a current California address for our response. Please allow up to thirty (30) days for a response. Mauldin & Jenkins reserves the right not to respond to such requests submitted to addresses other than those specified in the “How to Submit a Request” section below.

California Consumer Privacy Act of 2018 (CCPA)

This California Privacy Policy incorporates definitions of terms contained in the California Consumer Privacy Act of 2018 (CCPA) that do not apply to our general Privacy Policy.

Subject to applicable law, we reserve the right to transfer information we have about you in connection with a sale or transfer of all or any part of our business or assets (for example, if Mauldin & Jenkins were acquired or merged, or if it were reorganized, dissolved or liquidated).

RIGHTS TO KNOW AND ACCESS PERSONAL INFORMATION COLLECTED
If you are a California resident, under the CCPA you have the right to request that we disclose to you certain information about what personal information about you we collected, used, disclosed and sold in the preceding twelve (12) months (a “request to know”). Specifically, you have the right to request:

  • The specific pieces of personal information we have collected about you
  • The categories of personal information we have collected about you
  • The categories of sources from which that personal information was collected
  • The categories of personal information that we sold (if applicable), or disclosed for a business purpose, about you
  • The categories of third parties to whom the personal information was sold (if applicable) or disclosed for a business purpose
  • The business or commercial purpose for collecting or selling that personal information

You may submit a request to know up to two times in any 12-month period.

RIGHT TO REQUEST DELETION OF PERSONAL INFORMATION
With certain exceptions, if you are a California resident, you have the right to request that we delete personal information about you that we have collected from you (a “request to delete”). Instructions for submitting a request to delete can be found in the “How to Submit a Request or to Contact Us for More Information” section below. We may use a two-step process for online requests to delete where you must, first, submit the request to delete and then, second, separately confirm that you want your information deleted. Additional requirements may apply to requests to delete information that applies to a household.

Once we receive and have verified your request to delete (see “Verification Process” below), we will erase, and instruct any applicable service providers to delete, your personal information from our records, unless an exception applies, or de-identify or aggregate the personal information.

We may deny a request to delete if we or any of our service providers must maintain the personal information for any of the reasons set forth in Section 1798.105(d) of the CCPA.

RIGHT TO OPT-OUT OF SALE OF PERSONAL INFORMATION
If you are a California resident, under the CCPA you have the right to request that we not sell your personal information to third parties (a “request to opt-out”). Mauldin & Jenkins does not sell personal information to third parties. Instructions for submitting a request to opt-out can be found in the “How to Submit a Request or to Contact Us for More Information” section below.

A request to opt-out does not need to be a verifiable request. However, we may deny a request to opt-out if we reasonably and in good faith believe that the request is fraudulent, or if the request comes from an authorized agent and proof is not provided that the authorized agent has been authorized by you to act on your behalf, or as otherwise permitted under applicable law.

THE RIGHTS OF CALIFORNIA CONSUMERS WHO ARE UNDER 16 YEARS OF AGE
We do not intend to provide goods or services to, or collect information from, California consumers who are under 16 yes of age. We do not sell the personal information of consumers who are under 16 years of age, or of any other consumer, and we have no actual knowledge that we have sold any of that personal information.

NON-DISCRIMINATION
You have the right to equal service, and we will not discriminate against you because you exercise any of your rights under the CCPA, including, but not limited to, by

  • denying goods or services to you,
  • charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties,
  • providing a different level or quality of goods or services to you, or
  • suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services;
  • provided, that we may, under certain circumstances and subject to applicable law, charge consumers a different price or rate, or provide a different level or quality of goods or services to a consumer, if that difference is reasonably related to the
  • value provided to us by the consumer’s data. If we do so, we will notify the relevant consumers of any such price or service difference in accordance with applicable law.

When contacting us or submitting a request, please be sure to include your name, email address and telephone number. A member of our team will acknowledge your request and guide you through the verification process within ten (10) business days of our receipt of your request.

VERIFICATION PROCESS
Once we receive a request to know or delete, we must verify your identity before we can respond. We may also verify your identity before responding to a request to opt-out. You will be required to provide some or all of the following information for verification purposes:

  • Answers to questions that match personal information about you that we maintain,
  • Sufficient information that allows us to verify that you are the person whose personal information is the subject of the request, or the authorized agent of the person whose personal information is the subject of the request,
  • A signed declaration under penalty of perjury that you are the person whose personal information is the subject of the request, or the authorized agent of the person whose personal information is the subject of the request,
  • Sufficient detail of your request that allows us to properly understand, evaluate and respond to it.

If you maintain a password-protected account with us, we may also verify your identity through the authentication practices for that account that are then in place.

We may use a third-party verification service to verify your identity.

We will decline a request if we cannot reasonably verify that you are the person (or the authorized agent of the person) whose personal information is the subject of the request.

AUTHORIZED AGENTS
An “authorized agent” is either a natural person or a business entity registered with the California Secretary of State to conduct business in California that a consumer has authorized to act on their behalf, subject to the requirements of Section 999.326 of Title 11 of the California Code of Regulations, including the requirements set forth below.

You may use an authorized agent to submit a request to know, to delete or to opt-out. If you choose to use an authorized agent for any of these purposes, we will require you or your authorized agent to provide us with:

  • Either (a) your signed permission to the authorized agent to submit the request on your behalf or (b) a power of attorney pursuant to California Probate Code sections 4000 to 4465 that permits the authorized agent to submit the request on your behalf, and
  • Verification of your and the authorized agent’s identity.

We may also require you to:

  • Verify your identity directly with us
  • Verify your authorized agent’s identity
  • Directly confirm with us that you provided the authorized agent permission to submit the request.

We may deny a request from an authorized agent if proof is not submitted that the authorized agent has been authorized by you to act on your behalf.

RESPONSES TO REQUESTS
1. Acknowledging Receipt of the Request
We will acknowledge your request to know or to delete within ten (10) business days of our receipt of the request. In this acknowledgement, we will include information about how we will process the request, a description of our verification process, and approximately when you should expect a substantive response.

2. Substantive Response to Request to Know or Delete
We will respond to a verifiable request to know or delete within forty-five (45) calendar days. The 45-day period begins on the date we receive the request. If we cannot verify the request within the 45-day period, we may deny the request. If we cannot respond within the 45-day period, we will notify you in writing of the reason and let you know we need additional time, which may be up to an additional 45 calendar days.

Any disclosures in response to a request to know will cover only the 12-month period preceding our receipt of the verifiable request.

Our response will be in writing. If we cannot comply with your request, we will explain the reasons why we cannot comply.

If you have a password-protected account with us, we will deliver the response through that account. If you do not have a password-protected account, we will deliver the response by mail or e-mail, at your option.

We will not charge you a fee to process or respond to a verifiable request unless it is excessive, repetitive or manifestly unfounded. If we determine the request warrants a fee, we will tell you why and provide you with a cost estimate before completing the request. We will compensate you for any costs we require you to incur for verification of the request, if and to the extent required by applicable law.

3. Response to Request to Opt-Out
